Realtek SpA – RUT 76.960.007-8

In compliance with the provisions of articles 20 and 21 of Law No. 19,496 on Protection of Consumer Rights, as amended by Law No. 21,398, all laser measuring equipment, geomesura, point cloud capture and related products marketed by Realtek SpA have a legal warranty. Their conditions are described below.

1. Legal warranty

All equipment purchased through this site has legal warranty for a period of six (6) months counted from the date of receipt of the equipment, in accordance with Article 21 of Law No. 19,496, as amended by Law No. 21,398. The legal warranty operates by law and cannot be waived in advance by the customer.

The legal warranty applies in the following cases:

  • When the equipment is not suitable for the intended use or measurement due to manufacturing defects, materials, optical, electronic or mechanical components.
  • When the components or technical specifications of the equipment do not correspond to those stated in the product sheet, data sheet or labeling.
  • When the equipment has hidden defects or faults that prevent its normal use in measurement, surveying, geomatics or data capture tasks.
  • When Realtek SpA and the customer have agreed that the equipment must meet certain technical specifications and this does not occur.
  • When, after the warranty has been exercised and the technical service has been performed, deficiencies persist that render the equipment unfit for use.

2. Customer options

Once the defect has been verified, the customer has the non-waivable right to choose, at its discretion, any of the following alternatives, in accordance with Article 20 of Law No. 19.496:

  • Free repair of the equipment; or
  • Replacement of the equipment, upon return of the defective one; or
  • Full refund of the purchase price.

The foregoing is without prejudice to any compensation for damages that may be due in accordance with the law. The customer may direct their claim indistinctly to Realtek SpA as seller, or to the manufacturer or importer of the equipment, without any of them being able to redirect the claim.

3. How to enforce the warranty

To exercise the legal warranty, the customer must contact Realtek SpA within six months from receipt of the equipment, through the service channels available on the website, attaching:

  • Purchase order number or proof of purchase.
  • Description of the defect or failure presented by the equipment.
  • Photographs or technical background supporting the request, when possible.

Submitting the proof of purchase facilitates the process, but it is not the only condition for exercising the warranty. The condition of the equipment will be evaluated in accordance with the law.

4. Suspension of the term

The six-month legal warranty period is suspended while the equipment is being repaired or undergoing any other warranty management, both legal and conventional, in accordance with Article 21 of Law No. 19,496.

5. Manufacturer's conventional warranty

Equipment marketed by Realtek SpA may additionally have a conventional warranty granted by the manufacturer or importer. In that case, the term, conditions, and procedure for making it effective will be informed in the product sheet. If the term of the conventional warranty exceeds the legal six months, that longer term shall prevail.

The conventional warranty does not replace or restrict the legal warranty; both coexist and the customer may freely choose which to exercise. Realtek SpA may not offer the contracting of services or policies whose coverage corresponds to obligations that it must already assume under the legal warranty.

6. Exclusions from the legal warranty

The legal warranty does not cover damages or deficiencies caused by:

  • Misuse, improper use, or use of the equipment outside its technical specifications.
  • Normal wear and tear from normal use of the equipment over its useful life.
  • Physical damage caused by falls, impacts, humidity, exposure to extreme environmental conditions, or other external factors attributable to the customer.
  • Interventions, repairs, or modifications carried out by third parties not authorized by Realtek SpA or the manufacturer.
  • Use of the equipment under conditions or applications other than those indicated in the operating manual.
