In compliance with the provisions of Article 3 bis of Law No. 19,496 on Protection of Consumer Rights, as amended by Law No. 21,398, and the Decree No. 52 of 2024 of the Ministry of Economy, Development and Tourism, Realtek SpA hereby informs the conditions of the right of withdrawal and return applicable to purchases made through this website.

1. Right of withdrawal

As this is an e-commerce site, the customer has the right to unilaterally terminate the purchase contract, without stating a cause, within the term of ten (10) business days counted from the date of receipt of the acquired equipment, in accordance with article 3 bis of Law No. 19.496.

To exercise this right, the equipment must not have deteriorated due to an act attributable to the customer, nor have been used beyond its initial inspection. The customer may communicate their decision using the same means used to enter into the contract or other customer service channels available on our website.

2. Extension of the term

If Realtek SpA has not sent the written confirmation of the contract required by the Article 12 A of Law No. 19,496, the term to exercise the right of withdrawal shall be extended to ninety (90) days from receipt of the equipment.

3. Equipment excluded from the right of withdrawal

In accordance with article 4 of Decree No. 52 of 2024, the following equipment is excluded from the right of withdrawal due to its nature:

• Equipment that cannot be returned: those that, after receipt, have been connected, calibrated, configured, or used in the field beyond their initial inspection, so that they cannot be resold under the originally offered conditions. For example, 3D laser scanners, total stations, or GNSS receivers that have been operated on site or project.
• Equipment configured or modified according to customer specifications: those that, in whole or in part, have been prepared, calibrated, or programmed according to specific requirements provided by the customer, such as equipment with software licenses activated in the buyer's name, customized firmware configurations, or other technical adjustments expressly requested. This exclusion does not apply if Realtek SpA did not fully comply with the ordered specifications.

If a product falls into any of these categories, this will be communicated in a prominent and unequivocal manner on the product page and during the purchase process, before payment, in accordance with Article 6 of Decree No. 52 of 2024.

4. Conditions for exercising the right of withdrawal

For the withdrawal to be valid, the customer must meet the following conditions:

• Communicate their decision within 10 business days from receipt of the equipment, through the service channels available on the Realtek SpA website.
• Return the equipment in the same condition as received, without having been used beyond inspection, along with all accessories, manuals, certificates, cases, transport bags, and other original packaging items; or the respective value of those that cannot be returned, previously informed by Realtek SpA.
• The equipment must not show any damage, bumps, scratches, or alterations attributable to the customer.

5. Refund of the price paid

Once the right of withdrawal has been validly exercised, Realtek SpA shall be obliged to fully refund the sums paid, without withholding any expenses, as soon as possible and, in any case, within the following forty-five (45) days after the communication of the withdrawal, in accordance with Article 3 bis of Law No. 19.496.

If the price has been covered in whole or in part by a credit granted by a third party with the agreement of Realtek SpA, the exercise of the withdrawal will cancel said credit. The costs associated with that credit shall be borne by the customer when it has been granted by a third party.

6. Relationship with the legal warranty

The right of withdrawal is independent and compatible with the legal warranty rights established in articles 19, 20 and 21 of Law No. 19,496. The exclusion of the right of withdrawal with respect to a device does not affect or restrict in any way the exercise of the customer's legal warranty rights, which are governed by the Warranty Policy from Realtek SpA.
